Terms of service

These terms govern your use of discount-caskets.com, its sub-domains and any associated applications (together, the "Site"), operated by Discount Caskets. Together with our Privacy Policy, Shipping Policy and Refund Policy they form the whole agreement between you and us about the Site and supersede anything said or written before.

By using the Site you agree to these terms. If you do not accept them, please stop using the Site. We may change these terms at any time; the current version is always posted here, and continuing to use the Site after a change means you accept it. Please look over them from time to time.

1. Who these terms refer to

"We", "us" and "our" mean Discount Caskets. "You" means anyone using the Site, whether simply browsing or holding an account. "Content" means all text, information, images, audio, video and data offered through the Site.

2. Using the Site

We grant you a personal, non-exclusive, non-transferable and revocable right to use the Site for the purposes set out in these terms. Any other use is outside that permission.

You agree to comply with all applicable federal, state and local laws when using the Site. We may investigate suspected misuse or breaches of these terms and take whatever action we consider appropriate, including closing an account, reporting suspected unlawful activity to the authorities, and disclosing information where we are required or permitted to do so under our Privacy Policy.

3. Ordering, pricing and payment

Prices, product descriptions and availability may change without notice. We try hard to describe every casket accurately — gauge, materials, interior and hardware are listed on each product page — but we do not warrant that every description is entirely free of error. If a casket you receive is not as described, contact us and we will put it right.

We may refuse or cancel any order, including where a product has been listed at an incorrect price, where we cannot verify the billing or delivery details, or where an order appears fraudulent. If we cancel an order you have already paid for, we refund it in full.

You agree to give current, complete and accurate purchase and account information so we can complete your order and contact you if needed.

4. Delivery

Delivery within the contiguous United States is charged at a flat rate shown at checkout before you pay — Expedited (2–4 business days) or Standard (7–10 business days). Alaska and Hawaii are quoted individually. Delivery timings given on the Site are estimates based on stock, destination and the time of day an order is placed, and are not guaranteed against events outside our control such as weather, holidays or carrier disruption. 5. Your right to buy a casket anywhere

Under the FTC's Funeral Rule (16 CFR Part 453) a funeral home cannot refuse a casket you bought elsewhere, cannot charge you a fee for handling it, and cannot require you to be present when it is delivered. Nothing in these terms limits that right. We are not affiliated with any funeral home.

6. Returns, exchanges and cancellations

Changes and cancellations made before a casket leaves our warehouse are free of charge. After dispatch, returns and cancellations are subject to outbound shipping already incurred, the cost of the return shipment and a restocking fee, and must reach us within the periods set out in our Refund Policy, which forms part of these terms.

7. Disputed charges

If you think a charge is incorrect, contact us before raising it with your bank. Where a chargeback is brought against a charge that is subsequently found to be correct, we may recover the processing, bank and administrative costs we incur in responding to it.

8. Intellectual property

The Site and its Content are protected by copyright and trademark law. Trademarks and service marks appearing on the Site belong to us or to their respective owners, and nothing here grants you a right to use them. You may not copy, republish, redistribute or exploit any part of the Site without our written permission.

9. Links to other websites

The Site links to third-party websites — including, on our funeral home finder, the websites of funeral homes themselves. Those links are provided for convenience. We do not control those sites, we are not affiliated with them, and a link is not an endorsement, guarantee or recommendation. You visit them at your own risk and subject to their terms.

10. Availability of the Site

We may change or withdraw any part of the Site at any time without notice. The Site may be unavailable from time to time for maintenance or for reasons beyond our control. We are not responsible for interruptions, delays, transmission failures or unauthorized access to data arising from the operation of the internet, networks or your own equipment.

11. Disclaimer of warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, IN RELATION TO THE SITE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THIS SECTION CONCERNS THE SITE AND DOES NOT LIMIT ANY WARRANTY THAT APPLIES TO THE CASKETS THEMSELVES OR YOUR RIGHTS UNDER APPLICABLE CONSUMER LAW.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, ARISING FROM YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED THAT SUCH DAMAGES ARE POSSIBLE. NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED, AND SOME STATES DO NOT ALLOW SOME OF THESE EXCLUSIONS, IN WHICH CASE THEY DO NOT APPLY TO YOU.

13. Indemnity

You agree to indemnify us and our officers, employees and suppliers against any claim or demand, including reasonable legal fees, arising from your breach of these terms or your violation of any law or third-party right.

14. Severability, waiver and survival

If any provision of these terms is held unenforceable, that provision is to be applied as far as the law allows and the rest remain in force. Our failure to enforce a provision is not a waiver of it. Provisions that by their nature should survive termination will do so.

15. Governing law and time limit

These terms are governed by the laws of the United States and of the state in which Discount Caskets is established, without regard to conflict-of-law rules, and you agree to the jurisdiction of the courts there. Any claim relating to the Site must be brought within one year of the event giving rise to it.
